TCPA Ruling

In a Telephone Consumer Protection Act case centered around unwanted robocalls, the plaintiff claims he received numerous unsolicited calls about health insurance quotes. The plaintiff alleges these calls violated the TCPA due to their pre-recorded nature and occurred despite his number being on the National Do Not Call Registry. One of the defendants filed a counterclaim, accusing the plaintiff of fraud for supposedly using a false name to consent to calls and then suing for TCPA violations. The court ruled that the defendant sufficiently alleged a claim for fraud, including specific details of the plaintiff’s actions that purportedly aimed to entrap the defendant into a TCPA violation.
